Herbert Malarkey Roofing Co. and the Oregon Department of Environmental Quality have agreed on a fine of $1.45 million for air quality violations at the roofing company’s North Portland factory. That’s reduced from $2.1 million — then the biggest fine in Oregon DEQ history.

The roofing company — which makes shingles and other roofing materials — was emitting large amounts of the carcinogen formaldehyde and reported to the DEQ in 2018 that it had incorrectly measured its emissions. The company also failed to notify the DEQ when they modified their emissions unit in 2009.

Malarkey has 45 days to submit to DEQ its plan for maintaining pollution controls that were installed in 2020, and it must report to DEQ monthly to ensure their effectiveness.

Under the agreement, Malarkey must consider donating up to $1.16 million of the penalty to support the nearby environmental projects. If Malarkey does not identify such a project that meets DEQ requirements — among them that the company pays in full and that it doesn’t profit from the project — it must pay that amount to the state, as well.

Malarkey did not respond to a request for comment. The company was recently bought from family ownership by a Swiss company, The Holcim Group. The cash deal was valued at $1.35 billion.
